Between a pandemic and a hard place: A practical guide to bankruptcy and rehabilitation in the Land of Smiles
Thailand plays a pivotal role in global trade particularly in the automotive, agriculture, electronic, and tourism sectors with over USD 249 billion in exports in 2019, prior to the pandemic. Economic disruption has followed the closure of borders, travel restrictions, and supply chain disruptions. Thailand is struggling to stay afloat and the Central Bankruptcy Court has a tsunami of cases not seen since the 1997 Asian Financial Crisis.
Businesses are struggling to preserve value in their company but Thailand’s bankruptcy proceedings are unique and span a core Bankruptcy Act dating to 1940 and a newer 1999 addition modelled after Chapter 11 procedures in the U.S. allowing debtors to rebuild their businesses under court protection and supervision.
There are now alternatives to liquidation if you understand the options offered under the Act. This presentation isn’t aimed to be a rehash of the laws but rather a layman’s guide to putting together the pieces. The topic will be presented by Dr. Paul Crosio, an Australian lawyer with over 30 years’ experience in Thailand and Asia as both a company executive and a legal practitioner.
He will cover:
- The warning signs
- Liquidation or Rehabilitation : Making a choice
- What’s needed for a successful rehabilitation
- Pitfalls to avoid
- Alternatives to Bankruptcy
- The light at the end : Emerging from Rehabilitation
